Nelly's dog attack journey ❤️

Nelly was finally signed off from the Vets this morning , grand news for us and for her . I owe our Vet team a massive debt of gratitude , their care has been wonderful as has Nelly who has been amazing throughout this sad affair . I can now put her onesie on her as it covers the wound on her elbow which is almost healed , it also means that hopefully we can put the cone away which has been worn for six weeks now . The Vets are thrilled with her , it is a double edged sword in a way because this should never have happened , she should still have four legs but we must try to be positive and think that we are so lucky to still have our little love . She has lost a kilo in weight which I am told is normal after two major surgeries but as she is now eating really well , that weight should soon be back to normal . Thank you again for all the love and support for our super star xxx

Next week I am going to start court proceedings . I am seriously considering using a No Win No Fee solicitor because frankly , I dont know what I am doing , having never been in this situation before . I know they will take 25% but for me , its worth it to have someone else do all the paperwork , someone who knows what they are doing . I have the full statement from the Vets showing all the surgeries and treatments including the expensive hospital stay , plus Police Action report via e mail and the phone number of my witness so quite honestly , I dont see how I could lose ? I am seriously considering using a No Win No Fee solicitor
Just a word of warning - a lot of no win no fee solicitors have a minimum claim amount they require before they will take the case on. For example, the firm I worked at it was £25k before they would do no win no fee.

You could pay a solicitor privately but I don’t know how much they would charge. Usually it’s in the region of £175 per hour (or it is up here, down south it may be more).

I personally would do it yourself or start by going to see citizens advice and seeing what help they can provide. When you’re a litigant in person the court give you leeway if things aren’t perfect.

My bits of advice would be -

- write them a pre action letter. This gives the details of the claim, what you’re alleging and how much you’re seeking. This is before you issue proceedings and gives them warning the claim is coming but also the option to settle it before you issue proceedings. The court look more favourably on it.

- Keep it factual and what you claim factual. Have receipts of all of your losses - I.e vet bills etc. in cases like this people often try and add money on for distress or emotional harm etc. These aren’t quantifiable and make the claim a lot more complicated in terms of experts etc so I would stick to vet bills and any other losses you have receipts for.

- don’t forget interest. This is usually 8% and it’s per day. So you work out 8% of the claim and divide it by 365 then the amount of days you’re claiming for. I would do it from the last vet bill for ease otherwise you’ll have lots of calculations. This will potentially impact the court fee.
